Yes, an Area Variance is required anytime someone wants to construct or install a structure, pool, etc., closer to a neighboring property line than the Town Code allows.

Unless otherwise specified by the Zoning Board of Appeals, the decision by the ZBA of any appeal or request for a variance will expire if the applicant fails to obtain any necessary building permit or to comply with the conditions of the authorized permit within one year from the date of authorization. Therefore, if a building permit is issued within the variance time period specified by the ZBA, the expiration date of the building permit will take precedence.

Yes, a public hearing is required following application acceptance by the Zoning Board of Appeals. The Zoning Board of Appeals will review an application for acceptance at its initial placement on the ZBA's agenda. Once the ZBA deems an application to be complete and accepts the application, the ZBA will set a public hearing date for the next month's meeting.
